Terms and Conditions of Sale

This page (together with the documents expressly referred to on it) provides you with information about Majestic Materials and the legal terms and conditions (Terms) under which we sell products (Products) listed on our website (our site) to you.

These Terms apply to any contract between us for the sale of Products to you (Contract). Please read these Terms carefully and ensure you understand them before ordering any Products from our site. You will be asked to agree to these Terms before placing an order.

You should print or save a copy of these Terms for future reference.

We may update these Terms from time to time as outlined in clause 8. Every time you wish to order Products, please review these Terms to ensure you understand the terms that will apply. These Terms were last updated on 20th April 2025.

These Terms and any Contract between us are only in English.

1. Information about Us

1.1 We operate the website www.majestic-materials.com. We are Majestic Materials Ltd, a company registered in England and Wales under company number 16054504 with our registered office at Unit 1B Invar Road, Worsley, Manchester, United Kingdom, M27 9HF.

2. Our Products

2.1 The images of Products on our site are for illustrative purposes only. While we make every effort to display the colours accurately, we cannot guarantee that your computer’s display of colours accurately reflects the colour of the Products. Your Products may vary slightly from those shown in the images.

2.2 The packaging of Products may vary from that shown in images on our site.

2.3 Due to the sustainability of our materials, some composite products may vary slightly in shade despite ordering the same colour.

2.4 All Products shown on our site are subject to availability. If a product is unavailable, we will notify you by e-mail and not process your order.

3. Use of Our Site

Your use of our site is governed by our Terms of Website Use. Please review these, as they include important terms that apply to you.

4. How We Use Your Personal Information

We only use your personal information in accordance with our Privacy Policy. Please read this for important details.

5. If You Are a Consumer

This section applies only if you are a consumer.

5.1 You may only purchase Products if you are at least 18 years old.

5.2 As a consumer, you have legal rights concerning faulty or mis-described Products. These rights are not affected by these Terms. For advice, contact your local Citizens’ Advice Bureau or Trading Standards office.

6. If You Are a Business Customer

This section applies only if you are a business.

6.1 By ordering from our site, you confirm you have the authority to bind the business on whose behalf you are purchasing.

6.2 These Terms, along with any documents expressly referred to in them, constitute the entire agreement between us. You acknowledge you have not relied on any statements or promises made by us outside of these Terms.

7. How the Contract is Formed

7.1 Our order process allows you to check and amend errors before submitting your order. Please review your order at each stage.

7.2 After placing an order, you will receive an email acknowledging receipt, but this does not mean your order is accepted.

7.3 Our acceptance of your order will occur when we send you an email confirming your order (Confirmation). The Contract will be formed once you receive the Confirmation.

7.4 If a product is unavailable or there is an error in the price, we will notify you and not process your order. If payment has been made, we will refund you promptly.

8. Our Right to Vary These Terms

8.1 We may revise these Terms in the following circumstances:

  • Changes in how we accept payment
  • Changes in relevant laws or regulations.

8.2 Every time you order, the Terms in force at that time will apply.

8.3 When these Terms are revised, we will inform you by indicating the updated date.

9. Your Right of Return and Refund

9.1 If you are a consumer, you have the legal right to cancel your order within 7 working days of receipt of the Products. This right does not apply to made-to-measure or custom-made products.

9.2 To cancel, please contact us via email or post. You may wish to keep a copy of your cancellation notice.

9.3 If you cancel, we will refund the price of the Products and delivery charges. We will process the refund within 30 days.

9.4 If you return Products due to being faulty or mis-described, we will refund the full price and delivery charges, plus reasonable costs incurred.

9.5 Refunds will be issued to the card used to make the payment.

9.6 If Products were delivered to you, they must be returned promptly. For faulty items, we will arrange collection.

9.7 You have a duty to take care of the Products while they are in your possession.

10. Delivery

10.1 We aim to meet the estimated delivery date, but if an Event Outside Our Control occurs, we will notify you of a new delivery date.

10.2 Delivery is complete when we deliver the Products to the address provided.

10.3 Products are your responsibility from the time of delivery.

10.4 You own the Products once payment has been received in full.

11. International Delivery

11.1 If you are ordering from outside the UK, import duties and taxes may apply. These charges are your responsibility.

11.2 Please contact your local customs office for further information on these charges.

11.3 You must comply with all laws and regulations in the destination country.

12. Price of Products and Delivery Charges

12.1 Prices are quoted on our site, and we take care to ensure accuracy.

12.2 Product prices may change, but any price changes won’t affect orders already confirmed.

12.3 Product prices include VAT, but changes to VAT rates will be reflected in the final price.

12.4 Delivery charges are not included in the price and are quoted separately.

12.5 If we make an error in the price of a Product, we will notify you and offer you the option to continue with the correct price or cancel your order.

13. How to Pay

13.1 Payment can be made via credit or debit card. We accept all major cards.

13.2 Payment for Products and delivery charges is made in advance.

14. Manufacturer Guarantees

14.1 Some Products come with a manufacturer’s guarantee, which will be provided with the Product.

14.2 A manufacturer’s guarantee is in addition to your legal rights.

15. Our Liability (Business Customers)

15.1 We do not limit our liability for:

  • Death or injury caused by our negligence
  • Fraud
  • Breach of contract

15.2 Our liability is limited to the price of the Products.

16. Our Liability (Consumers)

16.1 We are responsible for loss or damage caused by our breach of these Terms or negligence.

16.2 We do not accept liability for any business-related losses.

16.3 We do not limit our liability for death, fraud, or defective products.

17. Events Outside Our Control

17.1 We are not liable for delays caused by events beyond our reasonable control, such as strikes or natural disasters.

17.2 If such an event affects our obligations, we will notify you and adjust the delivery schedule.

18. Communications

18.1 Communications must be in writing, which includes email.

18.2 You can contact us via email or post for cancellations or inquiries.

18.3 Notices will be sent to the contact details you provide.

19. Click & Collect Loading Disclaimer

By collecting goods from any Majestic Materials warehouse or collection point, the customer acknowledges and agrees to the following:

19.1 Any assistance provided by Majestic Materials staff in loading goods into the customer’s vehicle, van, truck, trailer, or any third-party vehicle is carried out entirely at the customer’s own risk.

19.2 Majestic Materials accepts no responsibility or liability for any damage caused to vehicles, property, goods, or persons during the loading process, including but not limited to scratches, dents, breakages, interior damage, glass damage, suspension issues, overloading, or securing of materials.

19.3 It is the customer’s responsibility to ensure that their vehicle is suitable, roadworthy, and legally capable of carrying the goods collected, including correct weight limits and load securing requirements.

19.4 Customers remain fully responsible for checking that all materials are loaded safely and securely before leaving the premises.

19.5 By accepting assistance with loading, the customer agrees not to hold Majestic Materials, its employees, contractors, or representatives liable for any direct or indirect loss, damage, or injury arising from the collection or loading of materials.

19.6 Majestic Materials reserves the right to refuse loading assistance where staff believe a vehicle is unsuitable or unsafe for the transportation of the goods.

20. Other Important Terms

20.1 We may transfer our rights and obligations, but this won’t affect your rights.

20.2 You cannot transfer your rights without our written consent.

20.3 This contract is between you and us, and no third parties can enforce its terms.

20.4 If a part of these Terms is found to be invalid, the rest will remain in effect.

20.5 Any delay in enforcing these Terms does not waive our rights.

20.6 These Terms are governed by English law. If you are a consumer, you can bring proceedings in England, Wales, Northern Ireland, or Scotland.

20.7 We will not file a copy of the Contract.
